Manufacturer-Based Plan, Technical Evaluation Report-TER

What is a TER and how is it used for permitting?

A TER or Technical Evaluation Report, is an engineering evaluation based on testing and/or rational analysis for the performance of a building product or component. In the case of Engineering Express, we are evaluating the structural aspects of a product only.

The authority for a qualified engineer to create a technical evaluation report is given in both the International and Florida Building Codes by an approved source (section 2.2). Numerous other codes are utilized in the creation of a TER which are listed on each corresponding evaluation report.   HOW IS A TECHNICAL EVALUATION REPORT USED FOR PERMITTING?

In Florida,  there are only 8 building product categories that require a product evaluation.  Those evaluations can even be a TER under the Local Product Approval method.  Learn more about this by clicking here. Also see additional topics below.

TER's contain performance limitations of the product being evaluated (mostly wind in the case of Engineering Express TER's).  These TER's have limiting values which another design professional must compare and approve to their site specific design.  TER's don't themselves approve any specific use.  They only list the limiting design values.

Think of a TER like a warning on a ladder that says the ladder only holds 300lb. the TER doesn't say who can use the ladder, only that the ladder can only hold that weight.  Someone else would need to determine who can and can't use the ladder based on each person's weight.

The permit applicant would need the sealed TER along with the design professional's plans and other documentation needed for each situation & jurisdiction to obtain the permit.  Engineering Express only provides the sealed report for permit, the rest is up to others.

WHY IS AN ENGINEER SEAL REQUIRED:

Since these evaluation documents are not issued by an accredited evaluation entity such as Miami Dade Product Control, Florida Statewide Product Approval System, ICC, TDI, among others, each document must bear the original signature and raised seal of the evaluating professional engineer.  Click Here to learn more about what documents need to be sealed and why. Engineering Express provides hundreds of TER's and Master Plans in our Online Plan Store. We typically design these for the manufacturers so their installers can quickly and easily obtain sealed copies to obtain their building permit.

Contact your local building official BEFORE ordering any engineering to determine what exactly is needed for permit.  We can assist in providing documentation to building officials to substantiate our reports. Manufacturers: Contact Us to discuss your need.

When is a Miami Dade NOA or FL Product Approval required, and how do TER’s & Master Plans Fit In?

FIRST, A WORD ABOUT FLORIDA & THE IBC

Florida is one of few states leading the Product Evaluation requirement.  Many other states accept documentation from Florida provided it meets the intended use in some form or another as the International Building Code has similar requirements.

The Florida Building Code (Building commission rule 61G20-3.001) requires certain products be tested and registered with the state of Florida through their statewide product approval system.  There are only some product types that require this type of approval, and this is within habitable space: 61G20-3.001 Scope.

(1) Products in the following categories as defined by subcategories of subsection 61G20-3.002(33) [pasted below], F.A.C., shall be available for approval by the Commission pursuant to Rule 61G20-3.007, F.A.C., for use in the state:
  • Panel Walls
  • Exterior Doors
  • Roofing Products
  • Skylights
  • Windows
  • Shutters
  • Structural components
  • Impact Protection Systems(2) This rule applies to approval of products and systems, which comprise the building envelope and structural frame, for compliance with the structural requirements of the Florida Building Code.

Outside of those product types an outside the building envelope, a Statewide Florida Product Approval is optional and in many cases isn't even applicable. Click here for a more general article that describe myths associated with approvals.

SO WHAT'S AN NOA?

Miami Dade NOA's, contrary to popular understanding, are in themselves NOT approved as a statewide product approval. They are adopted by the state system through the 'Local Approval Process'. NOA's also permit more evaluation categories than Florida's system since it's not state regulated, but still don't encompass every product type. NOA's are officially approve-able for use by building departments either by the NOA holder registering the NOA with the state system and obtaining a state FL number (if the product category is even applicable for the state system, sometimes it is not as described above) or by a process called a Local Product Approval (see FS 553.8425).  Thanks to this process, building officials typically see an NOA as meeting the Local Product Approval Process and consider them deemed to comply. Engineering Express are experts in Local Product Approvals, even owning and maintaining the industry's most recognized website on the topic, www.FloridaLocalApprovals.com.  Other evaluations (such as TER's - Technical Evaluation Reports - and Master Plan Sheets) are also permitted through this same local approval process, and in many cases can be approved just by the engineer rational analysis and evaluation per code.  There's much more on this topic by clicking the links below.

...It's just been a longstanding myth that an "NOA" is required for all building products...

What do I do if a TER or Master Plan isn’t enough for a permit?

THE BUILDING DEPARTMENT WON'T ACCEPT MY TECHNICAL EVALUATION REPORT (TER)?

Sometimes, municipalities or contract documents require more information than just submitting a TER (Technical Evaluation Report).  Typical reasons why TER's aren't approved include:

  • No certification is provided that the product meets the job specific project requirements
    • SOLUTION: A Design Professional needs to certify that the TER meets the job conditions either on their master plan, by a letter, calculations, or other approved method.
    • While Engineering Express are primarily Building Component Engineers, sometimes we can assist with this.  Submit a Job Request if you would like for us to review your need.

  • The TER is not signed and sealed by the evaluating engineer (a copy was submitted)

  • The product doesn't work for the intended use (the installation is beyond the product limitations)
    • SOLUTION:  Engineering Express can perform a site-specific analysis of the intended use. Typically with site specific evaluations a better answer can be achieved since we are looking at actual conditions as opposed to worst-case scenarios often assumed on evaluation reports.
    • We also offer a free plan swap (store or office credit) for TER's you just can't use (no refunds though).

  • Additional supporting documentation or calculations are required.
    • SOLUTION: Either your building engineer of record or Engineering Express can assist with additional supporting calculations.  Complete a Project Request to inquire how we can assist.

  • The municipality doesn't understand what a TER is or the legal requirements for  it to be accepted (they may think an NOA or FL approval is required)
    • SOLUTION:  Refer them to the below links, specifically https://www.engineeringexpress.com/wiki/masterplan/.  These articles contain supporting evidence you need to prove to building officials that these are code-compliant solutions.  Remember, it's a building official's job to uphold the building code, not make up their own rules.
    • Some products in Florida inside the Florida Rule do require more documentation. Learn more about that by clicking here.
    • If you still need help, we're here to assist.  Contact Us to discuss what's going on either in our Live Chat or our General Contact Form.
In each of the above cases, contact Engineering Express® for a site specific or hourly consultation to assist with approval.   [dt_divider style="thin" /]

What is a TER and how is it used for permitting?

What doesn’t a TER or Master Plan Sheet do?

FIRST, WHAT IS A TER?

TER's or Technical Evaluation Reports are evaluation of a product's performance.  They are not intended to approve product for a specific application, but rather provide limiting values based on installation options.

SO WHAT DOESN'T A TER DO?

TER's don't provide the full assembly or installation of a product and should be used in conjunction with manufacturer specifications, building plans, and other limitations of specified components (such as anchor installation requirements). TER's also don't have information about installation at a given address.  That's up to someone to interpret the information on the TER for use at a specific location. Engineering Express can also do that, but that's outside the limits of published TER's. TER's also don't have a universal approval when published.  Each document must be signed and sealed by the evaluating engineer to be valid for use per the building code(s) to which they reference. This mechanism helps limit misrepresentation of the information contained in the report.   SEE SO MUCH MORE ON THIS TOPIC BY CLICKING THE LINKS BELOW.

A PRACTICAL EXAMPLE

Think of a TER as the approval rating for a ladder, like '300lb limit'.  no matter where that ladder goes on earth it is subject to break above 300lb (with a reasonable safety factor). The ladder rating doesn't state the names of people or types of industries it's approved for, just like the TER states a wind pressure performance limit and not the cities, houses, or types of structures it can be used with.   [dt_divider style="thin" /]
